11月11日に DIACより2011年7月1日以降から適用される「新ポイントテスト」が発表されました。以下は What's New? Recent Changes in General Skilled Migration からの抜粋です。

Minister's announcement about the new points test – 11 November 2010

On 11 November 2010 the Minister for Immigration and Citizenship, the Hon Chris Bowen MP, announced the government's intention to implement a new points test applying to certain skilled migration applications made on or after 1 July 2011. The new points test will not apply to unfinalised applications lodged prior to 1 July 2011.

The new points test will not change the generous transitional arrangements in place until 31 December 2012 for former international students.

さて、この新しいポイントテストですが、以下のビザ申請に該当します。

● Subclass 885 Skilled Independent　● Subclass 886 Skilled Sponsored

● Subclass 175 Skilled Independent　● Subclass 176 Skilled Sponsored,
● Subclass 475 Skilled – Regional Sponsored　● Subclass 487 Skilled Regional Sponsored

以下の表は New Point Test になりますが、Pass Mark が現在の120点から65点に変更になります。実際は最大60点の SOL 職業点が表からなくなっていますので、感覚的には5点アップといった感じでしょうか。申請時の年齢は45歳から49歳に変更になっていますが、年齢点でいえば45-49歳は0点なので、45歳以上の方が Point Test をクリアするのは簡単ではなさそうです。英語力に関しては IELTS 6.0 では0点とより厳しくなりました。また、Work Experience がより重視される傾向にあります。

SOL の職業点がなくなったとはいえ、SOL に記載の職業をノミネートすることによって永住ビザを申請することには変更ありません。新しい SOL が発表されない限りなんともいえない部分もありますが、今回の変更は、より職業スキルのある人、より英語力のある人、より高い学位を取得している人に照準を置いたものであり、その条件を満たす人は永住ビアがより取得しやすくなるということになりそうです。

　2010年11月9日　ビザ相談＠DK　日本人のワーホリ・学生ビザ保持者はどのくらいいるの?？

DKでOK!!

日本人でワーキングホリデービザまたは学生ビザで来豪する人は、毎年どのくらいいるの？という質問をたまに受けますので、今回は DIAC が発表するデータを取り上げてみました。以下のデータは DIAC の Statistics から引用しています。

まず、ワーキングホリデービザですが、過去5年間の推移が以下の表になります。期間の PY は Program Year を意味し、これは Financial Year と同義、つまり 1July to 30 June を意味しています。日本人のワーホリは毎年1万人前後で推移していますが、年々減少傾向です。直近の 2009-2010 PY では 8089人 となっています。ちなみに人口が3分の1のお隣の韓国からは4倍以上の 34870人 がワーキングホリデーメーカーとして来豪しています。

次に、学生ビザの発給数を見てみましょう。以下の表は 2009-2010 PY の Top 25 です。Total で見ると日本の順位は11位で6373人。日本人には Subclass 570 つまり英語学校が一番人気で2576人、2番目に 572 カレッジで1749人、3番目に 573 大学（一部大学院含む）で1137人です。ちなみに 2009-2010 PY に65503人で1位だった India は 55% Down 、China は前期・今期とも54000人台で推移しています。このように各ビザに対する各国の発給数の推移を見ていくと、政府の移民政策が見えてきます。

　2010年7月1日　ビザ相談＠DK　7月以降、学生ビザ申請に必要な OSHC の加入期間が変更になります

オーストラリアで学生ビザを取得する際に加入が義務づけられている留学生用の健康保険 OSHC （Overseas Student Health Cover）。今までは、1年以上の学生ビザを申請する場合は、申請時に最短1年の OSHC 加入でビザが取得できましたが、7月以降は学生ビザ申請時に、学生ビザ期間分の OSHC の加入が義務づけられます。

また、コース期間と学生ビザ期間の関係ですが、10ヵ月以内のコースなら＋1ヶ月、10ヶ月超のコースなら+2ヶ月、10-12月に修了する10ヶ月超のコースなら翌年の3月15日までの学生ビザが通常は発行されます。詳しくは、Vocational Education and Training Sector: Temporary Visa (Subclass 572) - Assessment Level 1 の Length of stay を一例としてご参照ください。

The Department of Immigration and Citizenship has today confirmed to Medibank Private the following arrangements for the introduction of mandatory Visa Length Cover (VLC) for all student visa applicants from July 1, 2010.

The requirement is to become effective for those who apply for a student visa on or after July 1st, 2010.

Whilst it is best practice for all students to have VLC, there is no requirement by DIAC for current student visa holders to have VLC as their visa application has already been assessed and approved.

Current students who apply for a subsequent student visa after 1 July, 2010 will be required to provide evidence that they have visa length OSHC.

When completing a Confirmation of Enrolment (CoE) for commencing students on or after July 1st, 2010 selecting YES in response to the question about the provision of OSHC by the Education Provider is advising DIAC that OSHC has been arranged for the entire length of the student visa.

DIAC have asked education providers to include the expiry date of the OSHC policy and Policy Type (Single or Family) in the ‘Comment’ field – this will be considered as official advice that this requirement has been met for the student.

The DIAC assessment of student visa expiry dates, according to course length and course completion, has not changed. You will be able to accurately determine the visa expiry date from the information below:

Duration of Course Duration of Visa
● 10 months or less:  One month longer than the duration of the course
● Longer than 10 months: Two months longer than the duration of the course
● Longer than 10 months and finishing October-December: The visa will usually be granted up to March 15 of the following year

Examples
The OSHC start date should be the date the student is advised or expected to arrive in Australia.
In most cases, the duration of a student visa will be the same as the Overseas Student Health Cover (OSHC) policy.
1. If the student’s course finishes on 30 November 2011 the OSHC cover must expire after 30 November 2011 and on or before 15 March 2012.
2. If the student’s course finishes on 31 July 2011 the OSHC cover must expire after 31 July 2011 and on or before 30 September 2011.
3. If the student’s course finishes on 30 April 2011 and was less than 10 months the OSHC must expire after 30 April 2011 and before 31 May 2011.

● Changes to the Student visa lodgement and processing arrangements for the ACT and Regions Office
From 1 July 2010 all Student visa applications lodged by clients living in the Australian Capital Territory (ACT) and New South Wales (NSW) will be processed at the Sydney CBD Onshore Student Processing Centre.

From 1 July 2010
Applications lodged using a paper visa application form (form 157A, form 157G, form 157P) by clients living in the ACT and NSW should be directed to:

● Changes to online Student visa applications for clients living in Australia
From 1 July 2010 all Student visa applications lodged online by clients living in Australia will be processed at the Department of Immigration and Citizenship (the department) Onshore Student Processing Centres located in Sydney CBD, Adelaide and Perth.

From 1 July 2010
Student visa applications lodged online for clients living in Australia will be processed at one of three locations:
- Sydney CBD Onshore Student Processing Centre (for clients living in New South Wales, Australian Capital Territory and Tasmania)
- Adelaide Onshore Student Processing Centre (for clients living in South Australia and Victoria)
- Perth Onshore Student Processing Centre (for clients living in Western Australia, Northern Territory and Queensland).

2010年7月以降に Accountant としてノミネートして サブクラス485 サブクラス885 で永住ビザを申請する場合、

Skills assessment をパスためには、IELTS 7.0 以上または Skilled Migration Internship Program を修了することが条件となります。

From the 1st of July 2010, graduates of Australian accounting degree programs will have the option to complete the Skilled Migration Internship Program: Accounting (SMIPA) to gain an assessment that can be used to apply for general skilled migration (GSM).

Graduates who receive an assessment showing that they meet the following criteria will be able to use their assessments to apply for a 485 visa. These individuals will be able to use the 485 visa period to either to complete the Skilled Migration Internship Program: Accounting(SMIPA) OR gain an IELTS Academic band score of at least seven (7).

In order to qualify, graduates must have:
• A formal qualification assessed as being at least comparable to an Australian Bachelor degree.
• Completion of at least 9 out of the 12 core knowledge areas at tertiary level.
• IELTS Academic or General Test Report Form (TRF) to show they have a band score of at least six (6) on each of the four (4) components – speaking, reading, listening and writing.

CPA Australia will update assessments when they receive documentation showing that the graduate has:
• Completed the Skilled Migration Internship Program: Accounting(SMIPA) OR
• An IELTS Academic Test Report Form (TRF) number showing a band score of at least seven (7) on each of the four (4) components – speaking, reading, listening and writing

Minister's announcement of new Skilled Occupations List – 17 May

On 17 May 2010, the Minister for Immigration and Citizenship, Senator Chris Evans, announced the list of occupations included in the new Skilled Occupation List (SOL). The introduction of a new list of occupations is part of a package of reforms that reflects the Government's commitment to a labour market demand-driven Skilled Migration Program.

新 SOL は2010年7月1日から適用されますが、気になるのが経過措置です。上記リンク先からその内容を抜粋しました。

Proposed transitional arrangements
It is intended the new list would not apply to GSM applicants who at 8 February 2010:
• held a subclass 485 (skilled graduate) visa or had a pending subclass 485 visa application and who
apply for a permanent or provisional onshore GSM visa by 31 December 2012; or
• at the date of the announcement had a pending GSM visa application.

It is also intended that transitional arrangements would apply to international students who on 8 February 2010 held a subclass 572 (vocational education and training sector), subclass 573 (higher education sector) or subclass 574 (postgraduate research sector) student visa.

It is intended these students could apply for a subclass 485 (skilled graduate) visa using the current SOL
as long as they lodge their subclass 485 application by 31 December 2012.

2010年2月8日の時点ですでに サブクラス485 を申請済または取得済の人が、2012年12月31日までに サブクラス885 を申請する場合は、今回の 新 SOL は適用されないとのこと。また、サブクラス885 を2010年6月末までに申請する場合も、今回の 新 SOL は適用されません。

また、2010年2月8日の時点で Subclass 572, 573, 574 の学生ビザ、つまカレッジや大学・大学院の学生ビザを保持していた人は、2012年12月31日までに サブクラス485 を申請するのであれば、今回の 新 SOL は適用されません。しかし、その後、サブクラス885 を申請する際には 新 SOL が適用されますのでご注意を。

Temporary suspension of certain General Skilled Migration (GSM) applications – 7 May

The Australian Government has decided to temporarily suspend the acceptance of certain General Skilled Migration (GSM) visa applications. This temporary measure will begin on 8 May 2010 and is expected to remain in effect until the end of 30 June 2010.

The temporary suspension applies only to primary (main) applicants for the following visa subclasses:

• Subclass 175 – Skilled Independent (Migrant) visa

• Subclass 176 – Skilled Sponsored (Migrant) visa

• Subclass 475 – Skilled Regional Sponsored (Provisional) visa.

ビザ申請関連の書類だけでなく、オーストラリアに住んでいると、公的機関に提出する書類に Justice of the peace のサインが必要になるケースが多々あります。では、どこでもらえるの?? という質問をたまに受けますが、例えば NSW であれば、Looking for a JP? か探すことができます。JP の資格を持った人はいたるところにいますので、自分の住まいのご近所に尋ねてみてもすぐにわかるかと思います。また、警察に尋ねても最寄の JP Service を教えてくれます。

最近、サブクラス485 サブクラス885 での 永住ビザ申請 について、現状の変更点についていろいろとご質問を受けます。その中でよく話での出る「永住ビザを申請してから下りるまでどのくらいかかるの??」という内容について今回は取り上げます。Visas for Migrating to Australia as a Skilled Person - Application processing times によると以下のとおりです。

Processing times for applications lodged on or after 1 September 2007

# Applications from persons who are nominated by a state/territory government in accordance with an approved State Migration Plan or applicants who have nominated an occupation on the Critical Skills List (CSL).

つまり、留学生に人気のある調理師・菓子職人・美容師などの職種をノミネートして サブクラス485 を申請する場合は下りるまで12ヶ月以上、サブクラス885 の場合は2年以上かかります。以下に抜粋してる昨年9月に発表された内容では、2009年中までに申請された Offshore GSM について、Priority Categories に入っていない職種には、2012年以降まで審査されないということです。

つまり、最近の政府の傾向としては、審査期間を長くする、英語力の要求を上げる、技術査定の審査を複雑化する（かつ料金を上げる）、MODL を廃止してポイントを取りづらくする、などの改定を行い、調理師・菓子職人・美容師などの職種でノミネートしようとする人達に対して「永住ビザの取得をしずらくする」「永住ビザの取得を諦めさせる」という方向に動いています。今後もこの方向で進んでいくと思われますが、現状では「調理師・菓子職人・美容師などの職種をノミネートして永住ビザが完全に取得できなくなった」というわけではないので、今後の動向に注目していきましょう。

Q11 My application does not fall into one of the priority categories. When can I expect to have my application finalised?
A11 If your nominated occupation is not on the CSL and you have applied for an offshore GSM visa or intend to apply for an offshore GSM before the end of 2009, it is unlikely that your visa will be finalised before the end of 2012.
If your nominated occupation is not on the CSL and you applied for an onshore GSM visa or intend to apply for an onshore GSM before the end of 2009, it is unlikely that your visa will be finalised before the end of 2011.
Your ‘nominated occupation’ is the occupation you nominated at the time you lodged your application and cannot be changed.

Q12 If my nominated occupation is not on the CSL can I still receive priority processing?
A12 No. If your nominated occupation is not on the CSL your application will not be prioritised.
Please do not contact the department to request your application be exempt from the priority processing Direction. Case officers must adhere to the Minister for Immigration and Citizenship’s priority processing Direction.

Q13 What are my options if my application is unlikely to be finalised by the end of 2011 and I have applied for an onshore visa?
A13 The options available are:
• to continue to live and work in Australia (if your visa allows) whilst you await a decision on your visa application,
• to consider your eligibility for an employer sponsored visa, or other substantive visa, or
• to withdraw your application and return to your home country.
Note: If you choose to withdraw your application you will not be entitled to a refund of your Visa Application Charge (VAC).

Q14 What are my options if my application is unlikely to be finalised by 2012 and I applied for an offshore visa?
A14 The options available are:
• to continue to await a decision on your visa application,
• consider your eligibility for an employer sponsored visa, or
• to withdraw your application.
Note: if you choose to withdraw your application you will not be entitled to a refund of your Visa Application Charge (VAC).
Should you be in Australia after having applied for an offshore GSM visa, you will not be eligible for a bridging visa to remain in Australia while this application is being processed. You must apply for another visa or you will need to depart Australia.

　2010年2月9日　ビザ相談＠DK　2月8日付で突然 MODL がなくなりました!!

昨日から話題になっていますが、サブクラス885 で 永住ビザ申請 をするにあたり、ポイントテストで高得点が取れる MODL が昨日付けでなくなりました。つまり、MODL に職種が記載されているが故に留学生に人気のある Hospitality, Hairdressing, Accounting のコースですが、今後はこれらのコースを修了しても、ポイントテストで MODL の15ポイントが取れなくなります。今後の MODL については未定ですが、SOL (1121i) に職種が記載されている限りは、ポイントテストを満たせば サブクラス885 で 永住ビザ申請 は可能ですが、2010年度中に SOL (1121i) の職業も見直されるという話も出ています。

先の話は未定なので、現状の話を現在 Cookery コースに通う学生の例で簡単にまとめますと

MODL の15ポイントがなくても

● 29歳までに サブクラス485 を申請する人は、IELTS 6.0 で120ポイントに到達

● 34歳までに サブクラス485 を申請する人は、日本で4大卒または IELTS 7.0 で120ポイントに到達

● 39歳までに サブクラス485 を申請する人は、IELTS 7.0 で120ポイントに到達

● 44歳までに サブクラス485 を申請する人は、日本で4大卒かつ IELTS 7.0 で120ポイントに到達

● MODL の廃止が影響しない人は？
On 8 February 2010 the Minister for Immigration and Citizenship, Senator Chris Evans, announced the revocation of the MODL from 8 February 2010.
This change applies to all GSM applicants except those who, at the date of announcement:
• hold a Skilled—Graduate (subclass 485) visa, or had a pending subclass 485 visa application and had not yet lodged an application for a provisional or permanent GSM visa and who make an application by 31 December 2012, or
• have a pending GSM visa application.
Revocation of MODL does not affect applicants sponsored by an Australian employer.

● 現在、MODL 記載の職種に関連する学校に通っている人達への影響について
Q. I am currently undertaking study in a MODL occupation. Can I claim MODL points when I lodge my GSM application?
A. No. The MODL was revoked on 8 February 2010. This means that if you lodge your application after this date you will not be able to claim MODL points. MODL points can be claimed by people, who at 8 February 2010 are:
• holders of a subclass 485 visa granted before 8 February 2010
• applicants for a subclass 485 visa lodged before 8 February 2010, or
• applicants for a GSM visa lodged before 8 February 2010.
These applicants must lodge their GSM application by 31 December 2012.
International students should not make educational choices solely on the basis of hoping to achieve a particular migration outcome. The GSM program will continue to change and adapt to Australia’s economic needs.

New Skilled Occupation List from mid-2010
On 8 February 2010, the minister also announced the replacement of the current Skilled Occupation List (SOL) in the second half of 2010, with a new list of targeted occupations determined by the independent body, ‘Skills Australia’.
As the new SOL will be a comprehensive, targeted list, the current Critical Skills List will be revoked.

制度の変更が全体に与える影響でいえば、今回の変更より今年1月から適用された以下の2点の変更の方が、全体に与える影響が大きいのではないかと思われます。

Health Services Australia (HSA) Name Change

On Monday, 1 February 2010, Health Services Australia (HSA) changed its name to Medibank Health Solutions.
All 13 HSA offices around Australia are now known as Medibank Health Solutions and will continue to offer the same immigration services and remain at the same locations with the exception of Parramatta.

Medibank Health Solutions in Parramatta has moved to a new address
The new Parramatta office is located across the road from their previous site and is next to the Department of Immigration and Citizenship (DIAC) Parramatta Office.

サブクラス885 で 永住ビザ申請 をするにあたり必要になる IELTS のスコアに関して、DIAC の General Skilled Migration (GSM) Reforms に掲載された内容を以下に抜粋しました。ご参考にどうぞ。

簡単にまとめますと、Hospitality, Hairdressing などの Trade Occupations の職種をノミネートして サブクラス885 で 永住ビザ申請 をする場合、 必要になる IELTS のスコアが、4つのコンポーネントそれぞれに対して、現在は「5」以上ですが、2010年1月以降に 永住ビザ申請 する場合は「6」以上に上がります。

Changes to GSM English language requirement for trade occupations

The aim of the GSM Program is to select migrants who, because of the skills they possess, are more likely to find skilled employment shortly after they arrive in Australia. A high level of English language ability is recognised as being essential for achieving this objective.

The English language requirement for GSM applicants nominating a trade occupation will be increased to a minimum of 6.0 (Competent English) in each of the four components of the International English Language Testing System (IELTS) test. This increase in the IELTS score brings the English language requirement for trade occupations in line with other occupations for GSM visas, with trade occupations previously exempt from GSM changes introduced in September 2007.

For the provisional GSM visa subclasses, the threshold English language standard will be raised from an average score of IELTS 5.5 to an average score of IELTS 6. The change will affect applicants for the subclass 475 Offshore Skilled - Regional Sponsored and subclass 487 Onshore Skilled - Regional Sponsored Visa.

The increased English language requirement will apply to all new offshore GSM applications lodged after 1 July 2009 with Australian Standard Classification of Occupations (ASCO) Level 4 nominated trade occupations.

The increased English language requirement for onshore GSM applicants will apply from 1 January 2010.

サブクラス885 で 永住ビザ申請 をするにあたり、Hospitality, Hairdressing, Accounting のコースに関連する職種が、ポイントテストで高得点が取れる MODL から外れるのではないか?? という噂は何年も前からありますが、現状に関して、Carrick Institute of Education より以下の Media Release がありましたので、ご参考にどうぞ。

Hospitality, Hairdressing and Accounting Still Hot For Skills Shortages

The Australian Federal budget for 2009/10 was announced last night at 7.30pm. The issues related to skilled migration, the nationwide skills shortage and the role of private education institutes within the migration sector were addressed.

The Migration Occupations in Demand List (MODL) lists those occupations and specialisations identified by the Department of Education, Employment and Workplace Relations (DEEWR) that are in short supply.

Currently, the hospitality, hairdressing and accounting sectors are listed on the Migration Occupation in Demand List (MODL). The Australian Government announced that all three of these industries will remain on the MODL in the 2009/10 financial year despite speculation these courses would be removed.

The Australian Government states “The priority arrangements implemented on 1 January 2009 will remain in place for the 2009–10 skilled migration program, which has a cap of 108 100 places. This will ensure that employer-sponsored and government-sponsored visas continue to be fast-tracked and will remain uncapped.”

For international students this means hospitality, hairdressing and accounting remain some of the best course options for international students wanting to obtain part-time work and ultimately permanent residency in Australia.

Subclass 572 - Assessment Level 1 - How this Visa Works

Length of stay

This visa allows you to stay in Australia for the duration of your course. It permits multiple entries to Australia. Dependent family members who come with you to Australia are usually able to stay the same length of time as you, but they cannot stay once you have left the country.

The table below outlines the usual duration for a student visa.

● Duration of Course: 10 months or less
Duration of Visa: Your visa will usually be granted for one month longer than the end date of your course.

● Duration of Course: Longer than 10 months
Duration of Visa: Your visa will usually be granted for two months longer than the end date of your course, if your course ends before November.
Note: If your course ends in November or December, your visa will usually cease on March 15 of the following year.

Note: If your student visa expires before your graduation, you can apply for a Visitor visa. You will need a letter from your education provider which states the date of your graduation.

7月1日よりセカンドワーキングホリデービザ申請に必要であった3ヶ月間の Seasonal Work が Specified Work と名前を変えて、許容される仕事の範囲が広がりました。詳しくは Specified Work でご確認ください。以下は Specified Work の定義についてリンク先より抜粋。

Definition of specified work
Specified work is any type of work in the list below:
● plant and animal cultivation
- cultivating or propagating plants, fungi or their products or parts
- general maintenance crop work
- harvesting and/or packing fruit and vegetable crops
- immediate processing of animal products including shearing, butchery in an abattoir, packing and tanning (Note: Secondary processing of animal products, such as small goods processing and retail butchery is not eligible)

- immediate processing of plant products
- maintaining animals for the purpose of selling them or their bodily produce, including natural increase
- manufacturing dairy produce from raw material
- pruning and trimming vines and trees.
● fishing and pearling
- conducting operations relating directly to taking or catching fish and other aquatic species
- conducting operations relating directly to taking or culturing pearls or pearl shell.

- felling trees in a plantation or forest

Changes to the Migration Occupations in Demand List (MODL) – 17 May 2008
Twelve occupations have been added to the MODL, including five Computing Professional specialisations, Electronics Engineer, Optometrist and Dental Technican, as well as the trade occupations of Binder and Finisher, Landscape Gardener and Tree Surgeon. Computing Professional – specialising in Sybase SQL Server has been removed from the MODL.

Changes to the Skilled Occupations List (SOL) – 26 April 2008
Seven trade supervisor occupations have been included in the offshore skills assessment regime being conducted by Vocational Education and Training Assessment Services (VETASSESS).
The occupation of Seafarer – Ship's Surveyor (ASCO 2542–17) has been removed from the Skilled Occupations List (SOL).

4月26日以降、いくつか学生ビザの発給条件が変更になりましたが、その中の1つがビザラベル。以前は DIAC からのメールに「パスポートにラベルを貼りに DIAC まで来て下さい 」と記載がありましたが、4月26日以降に申請・交付された学生ビザに対してはその記載がなくなりました。以下は、4月26日以降に申請した学生ビザの発給通知メールに記載されている内容を抜粋しました。ご参考にどうぞ。

Information for students from other countries
You do not need a visa label when to travel to or enter Australia. Whether
you applied over the Internet or by paper application, you can check your
visa details through the Department's Visa Entitlement Verification Online
(VEVO) service. You can access VEVO by visiting
www.immi.gov.au/students/index.htm and clicking on the VEVO link. If you
have already registered to use VEVO you can use the password supplied to
you or your Transaction Reference Number.

 PASSPORT
 Your visa is linked to the passport number that you provided in your
 application. If you obtain a new passport after receiving this letter, you
 will need to provide a certified copy of your passport to the Department.
 Please scan the certified copy and email it to the Helpdesk at
 eVisa.Students.Helpdesk@immi.gov.au to advise the Department of your new
 passport details. Otherwise, you should contact your nearest Immigration
 office in Australia or overseas.
 Please note: If you do not provide us with the details of any new passport
 issued to you, you may experience significant delays at the airport and may
 be denied permission to board your plane.

ワーキングホリデービザ から観光ビザへの切替えは以下の2タイプあります。

● ワーキングホリデー・ビザから観光ビザ ETA (Visitor) (Subclass 976) に切替えたい!!

ETA (Visitor) (Subclass 976) はオーストラリア国外からのみ申請可能なので、登録の際はオーストラリア国外に出る必要があります。ワーキングホリデー・ビザからからの切替えに当たっては、Applying for this visa に以下の記載があります。

Working Holiday visa (subclass 417) holders

If you already hold a Working Holiday visa (subclass 417) and wish to enter Australia on an ETA, you must cancel your Working Holiday visa prior to travel. To have your Working Holiday visa cancelled, contact the Working Holiday visa processing centre.

つまり、ワーキングホリデー・ビザの有効期限内に日本へ帰国して ETA (Visitor) (Subclass 976) への切替えを行う場合は、まず Contact Us - Working Holiday and Work and Holiday Visas にある Enquiry Form を使って、Email で現在保有しているワーキングホリデー・ビザのキャンセルの申請をしてください（キャンセルしたい理由もしっかり明記してください）。Enquiry Form は現在保有してるワーキングホリデー・ビザが1回目か2回目かで異なりますので間違えないように。現在保有しているワーキングホリデー・ビザがキャンセルされた後、オンラインで ETA (Visitor) (Subclass 976) が申請可能となります。

● ワーキングホリデー・ビザから観光ビザ Tourist visa (subclass 676) に切替えたい!!

ワーキングホリデー・ビザから Tourist visa (subclass 676) に切替える場合ですが、ETA (Visitor) (Subclass 976) と同様にオーストラリア国内でワーキングホリデー・ビザから Tourist visa (subclass 676) への切り替えはできません。申請の際はオーストラリア国外に出る必要があります。ただし、Tourist visa (subclass 676) の場合、ワーキングホリデー・ビザの有効期限内でも、オーストラリア国外、例えば日本からなら申請が可能で、この場合は現在有効なワーキングホリデー・ビザが上書されます。なお、Tourist visa (subclass 676)  はDIACの Online Applications からオンラインでも申請可能です。

オーストラリア移民局 DIAC のサイト What's new for students に以下の記載があります。4月26日以降に発給される学生ビザには自動的に就業許可が付加されますので、別途に就業許可を申請する必要がなくなります。ただし、学生ビザ申請料は$430から$450に上がります。パスポートにビザラベルを貼る必要もなくなるようです。また、オーストラリア国外から学生ビザをオンラインで申請する際に入力するフォームに追加項目が設けられるようです。

● Permission to work arrangements for student visa holders
From 26 April 2008, people granted student visas will automatically receive permission to work with their visa grant. Most student visa holders will no longer need to apply separately in Australia for permission to work.

● Visa label-free arrangements for student visa holders
You do not need a visa label in your passport to confirm your immigration status and visa entitlements in Australia. Instead, your visa information is held electronically and can be accessed using the Visa Entitlement Verification Online (VEVO) service.

● Student eVisa form changes - from 26 April 2008
From 26 April 2008 the department will implement changes to the Student eVisa forms for clients applying from outside Australia. The eVisa forms available online will be changed to contain additional questions on Health and Character. To avoid any unnecessary delays in processing your application, you are encouraged to complete all of the additional information when completing your application online.

　2007年11月5日　ビザ相談＠DK　ワーホリから学生ビザを申請している間は仕事をしてもいいの??

ワーキングホリデー・メーカーの方が学生ビザを申請する際に「申請中に仕事をしてもいいの？」という質問をよく受けます。まず、学生ビザを申請すると ワーキングホリデー・ビザはキャンセルされ、申請中は Bridging Visas A を保有しているかたちになります。Bridging Visas には5タイプあり、Bridging Visas A の就労条件については Form 1024i に以下のとおり記載があります。

The Bridging visa A granted when an applicant applies for a substantive visa generally has  the same work condition as the substantive visa the applicant holds.

つまり、学生ビザ申請中はワーキングホリデー・ビザと同じ就労条件になるということです。ただし、学生ビザ発給後は学生ビザの就労条件に従いますので、学校開始後に Permission to work を取得するまではビザ上では働けませんのご注意を。

セカンド・ワーキングホリデー・ビザを申請予定まはた申請済みの方から、健康診断は必要なの？という質問をよく受けます。申請者の条件について詳細は Applicant: Second Working Holiday Visa Eligibility でご確認ください。以下はセカンド・ワーキングホリデーの健康診断について内容を抜粋しました。

Health requirements
If you are applying from outside Australia, the required health examinations are outlined under the heading 'Stay of greater than 3 months, up to and including 12 months'.
If you are applying from in Australia, the required health examinations are outlined under the heading 'Stay of greater than 12 months'.

まず、どのビザの人がどの健康診断を受けるかは Form 1163i に記載があります。上記の内容を他のビザと合わせて簡単に説明すると日本人の場合は以下のとおり。つまり、セカンド・ワーキングホリデーは申請場所によって、健康診断の有無が変わります。ご注意ください。

● 観光ビザ（ETA、オーストラリア国外で申請）3ヶ月以内の滞在なので健康診断は不要

● 学生ビザ（オーストラリア国内および国外の申請に共通）

3ヶ月以内の滞在には健康診断は不要。

毎年7月にいろいろ内容が変更になる移民法ですが、今年もいろいろ変更になっています。以下は主なものを抜粋しました。今年は9月に永住ビザ申請にかかわる内容が大きく変更になる予定なので、そちらもご注意ください。詳細は、オーストラリア移民局 DIAC のサイトでご確認ください。

Changing courses or education providers （学生ビザ保持者が学校やコースを変更する場合）

● Changing courses
同じレベルの Qualification の新しいコースへ変更する場合は、今のビザが切れない限り、新しい学生ビザを申請する必要がありません。

● Changing level of qualification
Qualification のレベルを変更する場合は、サブクラスが変わるので新しい学生ビザを申請してください。

● Changing education provider
2007年7月1日から、最初の12ヶ月間は学校を変更することができないという条件 'no change of provider' condition (8206) がなくなりました。ビザのラベルにこのコンディションが記載されていても、この効力はなく、学生は学校を変更するにあたって DIAC に申請書を提出する必要はありません。学校を変更する場合は、まず現在の学校に連絡をしてください。ただし、ほとんどの状況において、今のビザ発給後メイ ンのコースを最低6ヶ月間就学していない場合は、新しい学校への変更はできません。メインのコースを6ヶ月間終了する前に学校を変更する場合は、現在の学 校の承認が必要になります。Qualification のレベルを変更する場合は、サブクラスが変わるので新しい学生ビザを申請してください。

● Notify the department that you have changed provider
学校を変更する場合は、新しい学校の入学許可証 COE を DIAC に提出してください。

Amendments to student visa condition 8202
まず、2007年7月1日から National Code 2007 が施行されたことにともない、多くの学校が申込書一式を新フォームに変更していますのご注意ください。また、ESOS Act と National Code 2007 よって、学生ビザのコンディション 8202 が修正され、今までは出席率が80%を下回った場合、DIAC によって学生ビザがキャンセルされていましたが、7月1日以降は DIAC が学生ビザをキャンセルする判断基準が変わり、学校からの報告によって DIAC が学生ビザをキャンセルすることになりました。ということで、出席率が80%を下回っても問題がなさそうに見えますが、各学校の判断に委ねられていますので油断しないように。

　2007年5月29日　ビザ相談＠DK　MBA と調理師のコースを組合せて、永住ビザを申請できるの??

サブクラス880での永住ビザ申請にあたり、先日少し話題になたケースを1つご紹介。

Federal Magistrates Court of Australia のケースで、MRT (Migration Review Tribunal ) の決定が以下のように下りました。

Thongsuk v Minister for Immigration & Anor [2007] FMCA 655 (10 May 2007)

MIGRATION – MRT decision – onshore independent skilled residence visa – Australian degrees, diplomas or trade qualifications "relevant to" nominated skilled occupation – evaluation of relationship required – Tribunal found MBA not relevant to occupation of pastry cook – no jurisdictional error found.

つまり、経営学の修士号 MBA (Master of Business Administration) を取得している人が、調理師や菓子職人のCertificate III コースを終了することによって、サブクラス880の条件を満たして、調理師または菓子職人という職業をノミネートして永住ビザを申請することはできない、その組合わせはおかしいから駄目、ということです。ただし、ビジネスの Diploma コースと調理師や菓子職人の Certificate III コースの組合せなら問題ないようです。

　2007年4月23日　ビザ相談＠DK　永住ビザ申請に必要な Point Test の条件が変更になるの??

DKでOK!!

という話は昨年からよくされていて、その内容はいつ発表になるのか？ということが話題になっていましたが、今現在では  DIAC サイトで以下のような話が出ています。正確な内容および詳細は DIAC から正式発表があるまでお待ちください。

今回の変更は2007年9月1日以降に Skilled Visa （サブクラス880、136など）を申請する人に適用されます。変更内容はIELTS のスコアが上がることとワーク・エクスペリエンスが重要視される内容になります。IELTS の必要スコアは 5.0 以上が 6.0 以上に変更になる見込みです。ただし、Trade Occupations（調理師・美容師など）をノミネートして永住権を申請する場合は、IELTS の必要スコアは 5.0 以上で OK のようです。MODL に記載の職業をノミネートする場合で MODL Point を得るためには、最低12ヶ月のワーク・エクスペリエンスが必要になるも込みです。また、この新しい条件を満たせない申請者に対しては 18 month Skilled-Graduate（サブクラス485）が新設される予定です。主な内容は以下のとおりです。ご参考にどうぞ。

25 points / Proficient English: IELTS 7.0 以上
15 points / Competent English: IELTS 6.0 以上 (Vocational English: IELTS 5.0 以上)
● Work Experience

● MODL Points

DKでOK!!

最近のファームの仕事はどうなの？という質問もよく受けます。DK にはいろいろな人が毎日出入りしてますので、いろいろな情報や噂話？が飛び交っています。以下は最近 QLD 州と VIC 州のファームに滞在していた人から聞いた話です。ご参考にどうぞ。

● VIC 州 - 仕事はあるが宿がないところが多いようです。滞在していた人の話によると、テントを自分で用意してキャラバン・パークに泊まる場合でも、レントが週 $100 だったとか。ただし、共同のシャワーは完備。

● TAS 州 - 仕事がないようです。

● NSW - 仕事がない。

● ＱLD 州 - Bundaberg にピッキングに行く人は多いですが、最近は仕事がないようです。滞在していた人の話によるとローカルですら仕事がないそう。Back Packer ではファームから仕事が回ってこないので、レントを返却した上で別の場所へ移動するよう勧めてるところもあるとのこと。
しかし、Cairns のローカルの人の話によると North QLD のバナナ・ファームが人手不足らしい。

　2006年11月6日　ビザ相談＠DK　オーストラリアからニュージーランドに行きたい!! ビザはいるの??

という質問をたまに受けます。観光目的で3ヶ月以内の滞在であればニュージーランドへの入国にはビザは不要です。以下は ニュージーランド大使館 のサイトから抜粋しています。ご参考にどうぞ。

訪問者ビザ申請の手引き −日本国籍及び韓国籍
日本国籍、及び韓国籍の方が訪問者としてニュージーランドへ入国される場合、滞在期間が3ヶ月以内であれば、ビザを事前に申請する必要はありません。3ヶ 月以上の滞在を御希望の場合は訪問者ビザが必要です。訪問者として滞在できるのは18ヶ月以内に合計で9ヶ月間までです。また、3ヶ月以内1コースに限っ た修学であれば、訪問者の範囲内で実行することができます（ただし、高校の勉強など、コース全体の長さが3ヶ月を超えるものの一部をとって、3ヶ月以内の 勉強をする場合は訪問者ビザではなく、学生ビザを取得する必要があります）。訪問者ビザでの就労は厳しく禁止されています。

　2006年8月11日　ビザ相談＠DK　就労許可 Permission to work オンライン申請マニュアル!!

オーストラリア移民局 DIAC のサイトが7月からリニューアルされています。それに合わせて、就労許可（Permission to work） オンライン申請マニュアル を最新の内容で作成しました。内容は現在学生ビザでオーストラリアに滞在していて、すでに学校も始まっている方が、これから週20時間の範囲でパートタイムの仕事を始めるにあたり、就労許可（Permission to work）をオンラインで取得するという状況を対象としたもの。学生ビザ保持者が就労する場合、就労許可（Permission to work）が必ず必要になります。

もっともよくある質問は「オンライン申請で次のページに進むことができない!!」というものですが、原因は2つ考えられます。1つは学生ビザ取得の対象となっている学校がまだ始まっていない（学校開始後しか申請できません）。もう1つは学校が始まっているのに申請ができない場合で、これは学校側が必要な手続きを行っていないことが原因です。申請できないと質問される場合、多くのケースの原因は後者なので、速やかに学校に文句を言ってください。

例えば学生ビザでオーストラリアに長期で滞在している場合など、領事館でパスポートの更新をされる方も多いかと思います。その場合、オーストラリア移民局 DIAC に Form 929 を提出する必要があります。これはパスポートが盗難にあった場合も同様です。「パスポートの内容が変わった場合は、 DIAC で変更の手続きが必要になる」とお考えください。

オーストラリア移民局 DIAC のサイトの Working Holiday Visa (Subclass 417) によると、2006年7月1日以降の新ルールは以下のとおり。詳しくは英文もご参照ください。

ワーキングホリデー・ビザの申請が2006年7月1日以降の場合

● 同一雇用主の元で6ヶ月までの就労および4ヶ月までの就学が可能

ワーキングホリデー・ビザの申請が2006年7月1日より前の場合

● 同一雇用主の元で6ヶ月までの就労および3ヶ月までの就学が可能

What does this visa let me do?

If you are granted this visa you can:

● stay up to 12 months

● leave and re-enter Australia any number of times while the visa is valid

● work in Australia for up to 6 months with each employer

● study or train for up to 4 months.

Note: If you applied for your Working Holiday visa before 1 July 2006, you may:

● undertake study or training for up to 3 months

● work for up to 6 months with each employer

Important: Your visa will have a condition limiting work with each employer to 3 months however, all visa holders have been granted permission to work for up to 6 months with each employer.

　2006年5月5日　大学　オーストラリアでは、どこの大学がいいの???

「どこの大学がいいの?」という質問は、日本人の学生からはよく聞かれます。「永住権が狙える学部があって、とにかく安い大学」という質問もよくありますが･･･

まず、オーストラリアには40の大学があり、当然学部によってそれぞれの大学に対する評価も違います。また、各大学には多くのキャンパスがあり、キャンパスごとに学部の評価も異なります。この評価について一般的によく参照されるのが The Good Universities Guide です。関心のある方は1冊購入されてはいかがでしょうか？ The Hobsons Guides website の The Good Universities Guides Website でも確認できますが有料です。例えば、2006年度版によると、Accounting コースで一番難易度が高いのは、Macquarie, Sydney, Monash, UTS, Queensland の5校（キャンパス名は省略）となっています。また、昨年発表された Teaching Performance Rankings では、何と? Wollongong が1位です。世界の大学ランキングに目を向けてみると、The THES の World University Rankings でも各大学の位置付けが確認できます（これも有料）。ちなみに World University Rankings 2004 によれば、オーストラリアの大学でトップは ANU で16位でした。

という質問はよく受けます。永住権取得については「簡単」ではありませんが「多くの人にチャンスがある」のがオーストラリアであると言えます。なぜなら、指定された職業（MODL記載の職業）の資格を得ることができる学校で2年間就学して、更に IELTS 6.0 以上の英語力があれば、年齢が39歳までの方は永住ビザ申請が可能になります（詳しくは こちら ）。

こんなに多くの人に永住権取得のチャンスがあって、オーストラリアと同程度以上の経済力がある国は珍しいのではないでしょうか？

　2006年4月18日　ビザ相談＠DK　親子で来豪!! Student Guardian Visa を取得したい!!

という問合せをたまに受けます。18歳未満の人が学生ビザを取得するには、必ず保護者としての Student Guardian が必要になります。子供が18歳未満で親子でオーストラリアに滞在することを希望する場合、子供が Student Visa で学校に通い、親は Student Guardian Visa を取得して同居する、という方法があります。Student Guardian Visa については DIAC のサイト Student Guardian Visa で条件・申請方法をご確認ください。

　2006年3月13日　ビザ相談＠DK　学生ビザの申請にあたり、HSA で健康診断を受けたい!!

ビザの申請にあたり、健康診断の受診が必要になるケースは多いと思います。学生ビザ申請の場合は、申請から遡って1年以内に健康診断を受けている必要があります。健康診断は HSA （Health Service Australia）で受診できます。City のそばなら Central 駅近くの以下の場所で受診できます。

● 診断時の必要書類は次の2つ: 「26A」（Medical Examination）　「160A」（Chest X-Ray）

建物や看板は写真をご参照ください。写真の建物の5階になります。ちなみに隣には英語学校 Canterbury Language Academy があります。健康診断の事前予約は、電話または オンライン でOK。朝一番の受診の予約をして、持参する書類をすべて事前に記入しておけば、最短で30分程度で終了。ただし、混み合ってくるとかなり時間がかかるのでご注意を。

学生ビザをオーストラリア国内からオンラインで申請され方は、ビザ・ステッカーを取りにDIACに行くことをお忘れなく。この場合は、最寄の DIAC で OK です。ちなみに DIAC には電話（131 881）で質問・問合せも可能ですが、担当者によって発言内容が異なるケースがあるのはご愛嬌でしょうか･･･　ご注意ください。

　2005年11月27日　ビザ相談＠DK　2回目の ワーキングホリデー・ビザを申請したい!!

今月から受付が始まった2回目のワーキングホリデー申請。オーストラリアでも申請できるので1回目の ワーキングホリデーのビザが切れる前に申請してそのままもう1年滞在しよう!! という方も多いようです。

2回目のワーキングホリデーの申請条件は、指定されたファームで3ヶ月以上仕事をするということ以外は、1回目のワーキングホリデーの申請条件と基本的には同じになります（詳しくは こちら ）。2回目のワーキングホリデーの申請については申請書（1150）に詳しく記載されています。最新の申請料の一覧はこちら（990i ）。この中にはオーストラリア国内でワーキングホリデーを申請する場合の金額が記載されていませんが、オーストラリア国外で申請する金額（$180）と同じようです。申請料をクレジットカードで支払うことができる場合は、こちら からオンラインで申請もできます。ただし、 Seasonal Worker in regional Australia として3ヶ月以上働いた証明書（1263）などの必要書類については、申請書を手書きで記入した場合と同様に、郵送でタスマニアの受付窓口（住所は 1150 参照）に送る必要があります。また、1回目と2回目のワーキングホリデーを続けて申請するような場合（1年以上オーストラリアに滞在することになる場合）は学生ビザ申請時と同様に健康診断を受ける必要があります。

　2005年11月16日　サービス＠DK　OSHC の料金って違うの?

オーストラリアで学生ビザを取得する際に加入が義務づけられている留学生用の健康保険 OSHC （Overseas Student Health Cover）。通常は学校に授業料と一緒に保険料も支払うめ、学校が取扱う保険会社で加入するケースがほとんどですが、実は保険会社によって若干料金が違います。

例えば、一番よく見かける Medibank は1年の保険料が $324 。Worldcare の場合は1年の保険料が $329 。Australian Health Management と BUPA の場合は1年の保険料が $299 。料金は毎年上昇傾向にあるため申込みの際にご確認ください。また、カバーされる保険内容や追加できる保険内容などについては、各社Webサイトでご確認ください。

学校に1年以上通う場合でも、ビザ申請時に支払う OSHC の保険料は通常1年分だけであるケースが多いので、保険が切れる前に延長の手続きをお忘れなく。Webサイトで延長手続きは可能です!!
